Kansas City Abusive Debt Collector Litigation Attorney

A Better Law Firm for Bankruptcy, Family Law and Traffic Matters

The debt collection services industry is one of the top complained-about industries to the Federal Trade Commission (FTC). From 1999 to 2010, the debt collection industry was the top complained about industry in the United States of America. This was the case even with the Fair Debt Collection Practices Act ("FDCPA") in place, which oversees and regulates debt collection activities and their behavior. Quite often debt collectors are not properly trained and informed and also work in an industry that has a very high turnover rate of employees.

Some other reasons debt collection agencies use abusive and illegal strategies against debtors is that most debt collection agencies know they will not be reprimanded and can get away with their illegal strategies and behaviors because (1) most people do not know the debt collection laws; (2) it's fairly difficult to prove the illegal harassment has taken place and even harder to prosecute it without an experienced debt collection attorney; and (3) there is also a loophole in the debt collection law that allows these agencies who get do actually get prosecuted for these crimes to close their current business and just open up a new company and new identity, and thus avoiding any existing legal injunctions and allowing them to continue to operate in the same illegal and harassing manner.

What can you do if a debt collection agency is harassing you?

  1. Send the debt collection agency a certified letter with a return receipt requested, stating that you believe they are in violation of the FDCPA or your state's debt collection laws; and, if also you want to:
  2. Request that the debt collection agency stop calling you at home and or at your place of employment.
  3. You can also file a complaint over the internet on the site www.ftc.gov. The FTC is the agency that is in responsible for regulating collection agencies. The ftc will not handle your claim personally, but you should report the harassing debt collection agency because the ftc will sanction the agency in question if it gets enough complaints about their business practices.
  4. You may also get further evidence by recording your phone conversations with the debt collectors. If you can prove that these debt collection agencies used illegal and harassing strategies, you can sue them for damages under the laws of the FDCPA and in the state of Kansas, the Kansas Consumer Protection Act. It is also very important to write down all of the collection activities employed by the debt collection agencies.
  5. CALL LAW IN KANSAS CITY'S ATTORNEYS ASAP!

Consumer Protection laws are in part designed to protect people against these debt collection agencies illegal tactics. Three of these laws are the Kansas Consumer Protection Act ("KCPA"), the Missouri Merchandising Practices Act ("MMPA") and the Fair Debt Collection Practices Act ("FDCPA"). All of these are examples of government legislation that is directly aimed to protect the interests of the general public. If you think that your consumer rights have been violated, call the Law In Kansas City Attorneys for a free consultation.
